Acceptance of Terms

By accessing or using ShareList ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

ShareList is a collaborative checklist application that allows users to:

  • Create and manage personal shopping lists and checklists
  • Share lists with friends, family, and groups
  • Collaborate in real-time on shared lists
  • Upload and attach images to lists and items
  • Organize items with categories, notes, and media attachments
  • Sync data across multiple devices (web and mobile)
  • Receive push notifications about list activities
  • Subscribe to ShareList Pro for premium features
  • Purchase and sell premium templates in the Template Marketplace

    • User Accounts

    Account Creation

  • You must provide accurate, complete, and current information during registration
  • Email address is optional but recommended for account recovery
  • You are responsible for safeguarding your account password
  • You must notify us immediately of any unauthorized access to your account
  • One person or legal entity may not maintain more than one account

    • Authentication Methods

    You may create an account using one of the following methods:

  • Email/Password : Register with your email address and create a password
  • Sign in with Google : Use your Google account for quick registration and login
  • Sign in with Apple : Use your Apple ID for registration and login (iOS and web)

    • When using OAuth providers (Google or Apple), you agree to their respective terms of service. We receive limited profile information (name, email) from these providers to create your account.

    Account Security

  • You are responsible for all activities under your account
  • We reserve the right to suspend or terminate accounts that violate these Terms
  • We may refuse service or close accounts for any reason at our discretion
  • Account credentials must not be shared with others

    • Subscription Plans and Pricing

    Service Tiers

    ShareList offers the following subscription tiers:

  • ShareList Free : Basic features at no cost, including list creation, sharing, and collaboration
  • ShareList Pro : Premium subscription with enhanced features, priced at $7.99 AUD per month

    • Free Trial

  • Trial Period : New users may be eligible for a 1 month free trial of ShareList Pro
  • One Trial Per User : Each user is entitled to only one free trial . Creating multiple accounts to obtain additional trials is prohibited
  • After Trial : Upon trial expiration, you will be automatically charged unless you cancel before the trial ends
  • No Trial Abuse : We reserve the right to revoke trials and terminate accounts that abuse the trial system

    • Pricing and Currency

  • Base Currency : All prices are displayed in Australian Dollars (AUD) unless otherwise noted
  • Price Changes : We may change subscription prices at any time. Changes take effect at your next billing cycle
  • Regional Pricing : Prices may vary by region when purchasing through Apple App Store or Google Play Store
  • Taxes : Prices may be subject to applicable taxes depending on your jurisdiction

    • Billing and Payment

    Payment Methods

    Depending on your platform, payments are processed through:

  • Web (sharelist.app) : Stripe processes all web payments
  • iOS (App Store) : Apple processes all payments through your Apple ID
  • Android (Google Play) : Google processes all payments through your Google Play account

    • Subscription Billing

  • Billing Cycle : Subscriptions are billed monthly on the anniversary of your subscription start date
  • Automatic Renewal : Subscriptions automatically renew each billing period unless canceled
  • Payment Authorization : By subscribing, you authorize recurring charges to your payment method
  • Failed Payments : If payment fails, your access to Pro features may be suspended until successful

    • Cancellation

  • Cancel Anytime : You may cancel your subscription at any time
  • Access Until Period End : After cancellation, you retain access to Pro features until the end of your billing period
  • How to Cancel : iOS - Settings > Apple ID > Subscriptions; Android - Google Play > Subscriptions; Web - Settings page or Stripe Customer Portal
  • No Partial Refunds : Cancellation does not entitle you to a refund for the current billing period

    • Refund Policy

  • General Policy : Subscription fees are generally non-refundable
  • Web Purchases (Stripe) : Refund requests may be considered on a case-by-case basis within 14 days. Contact support@sharelist.app
  • App Store Purchases : Refunds for iOS purchases must be requested through Apple
  • Google Play Purchases : Refunds for Android purchases must be requested through Google Play
  • Trial Period : If you cancel during your free trial, you will not be charged

    • Template Marketplace

    Overview

    ShareList provides a marketplace where users can create, sell, and purchase premium templates. Templates are pre-made lists that users can purchase and add to their account.

    Template Types

  • Free Templates : Available to all users at no cost
  • Premium Templates : Paid templates created by users, priced between $2.99 and $39.99 AUD

    • Purchasing Templates

  • One-Time Purchase : Template purchases are one-time payments, not subscriptions
  • Permanent Access : Once purchased, you have permanent access to use the template
  • No Resale : Purchased templates are for personal use only and may not be resold
  • Payment Processing : Template purchases are processed through Stripe (web) or in-app purchase (mobile)

    • Template Purchase Refunds

  • Digital Products : Template purchases are non-refundable as they are digital products delivered immediately
  • Exceptions : Refunds may be considered if the template is defective or significantly misrepresented
  • App Store Purchases : Must follow Apple or Google's respective refund policies

    • Selling Templates (Creator Terms)

    Eligibility

  • You must have an active ShareList account in good standing
  • You must connect a Stripe Express account to receive payouts
  • You must comply with all applicable tax laws in your jurisdiction
  • ShareList Pro subscription may be required to create premium templates

    • Creator Earnings

  • Revenue Share : Template creators receive 85% of the net amount (after payment processor fees)
  • Platform Fee : ShareList retains 15% of the net amount
  • App Store Fees : For mobile purchases, Apple/Google takes their commission (15-30%) before the revenue share calculation
  • Example (Web) : For a $9.99 template, after Stripe fees (~3%), creators receive approximately $8.24 (85% of net)
  • Example (Mobile) : For a $9.99 template with 15% App Store fee, creators receive approximately $7.22 (85% of $8.49 net)

    • Payouts

  • Minimum Payout : Earnings are accumulated until they reach the minimum payout threshold
  • Payout Schedule : Payouts are processed periodically via Stripe Connect
  • Stripe Connect Required : You must set up a valid Stripe Express account to receive payouts
  • Tax Responsibility : You are solely responsible for reporting and paying any taxes on your earnings

    • Creator Responsibilities

  • Original Content : Templates must be your original work or you must have rights to sell them
  • Accurate Descriptions : Template listings must accurately describe the content
  • No Prohibited Content : Templates must comply with our content guidelines
  • Price Integrity : Prices must be set within our allowed price tiers

    • Media Upload and Intellectual Property

    User Content Rights

  • You retain all ownership rights to images and media you upload to ShareList
  • By uploading, you grant ShareList a non-exclusive, worldwide, royalty-free license to store, display, process, and deliver your content solely to provide the Service
  • This license allows us to: store files on Firebase Cloud Storage, display images in the app, create thumbnails, and enable sharing when you request it
  • License termination : This license ends when you delete the content or your account

    • User Warranties and Responsibilities

    You represent and warrant that:

  • You own or have permission to upload all media and content
  • Uploaded content does not infringe third-party copyrights, trademarks, or privacy rights
  • You have obtained necessary consents to upload images containing other people
  • Content complies with all applicable laws and regulations
  • You may not upload copyrighted images or media without proper authorization

    • File Requirements and Restrictions

  • Maximum file size : 10MB per image
  • Accepted formats : JPG, PNG, WEBP
  • Prohibited content : Images must not contain malware, viruses, or harmful code
  • Storage limits : Reasonable usage expected; excessive storage may result in restrictions
  • Quality : Images may be automatically compressed for optimal performance

    • Content Moderation and Prohibited Content

    Prohibited Image Content

    You may not upload images or media containing:

  • Illegal, harmful, violent, or graphic content
  • Sexually explicit or adult content
  • Content depicting minors inappropriately
  • Copyrighted material without authorization
  • Private information of others without consent (addresses, documents, personal data)
  • Spam, malware, viruses, or deceptive content
  • Content that violates any person's privacy or publicity rights
  • Hate speech, harassment, or discriminatory content

    • Moderation Rights and Process

  • We reserve the right to review, remove, or refuse any uploaded content at our discretion
  • Automated systems may flag potentially violating content for review
  • We do not actively monitor all uploads but respond promptly to reports
  • Repeat violations may result in account suspension or permanent termination
  • Content removal does not entitle you to refunds or compensation
  • We may remove content without prior notice if it violates these Terms or applicable laws

    • Reporting Inappropriate Content

  • Users can report inappropriate content through the app or by emailing: admin@sharelist.live
  • Reports are reviewed within 48 hours
  • Actions taken include content removal, user warnings, or account termination
  • False reports may result in penalties for the reporting user

    • User Content and Conduct

    Content Ownership

  • You retain ownership of all content you create and upload to ShareList
  • By using the Service, you grant us a license to use, store, and share your content as necessary to provide the Service
  • We do not claim ownership of your lists, items, images, or other user-generated content

    • Acceptable Use

    You agree not to use ShareList to:

  • Violate any local, state, national, or international law or regulation
  • Share content that is illegal, harmful, threatening, abusive, or invasive of privacy
  • Impersonate any person or entity or misrepresent your affiliation
  • Upload malicious code, viruses, or any harmful computer code
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Use the Service for commercial purposes without our written consent
  • Scrape, data mine, or use automated tools to access the Service

    • Content Guidelines

  • Keep shared content appropriate for all group members
  • Respect other users' privacy and personal information
  • Do not share content that infringes on intellectual property rights
  • Report inappropriate content or behavior to our support team
  • Maintain respectful and constructive collaboration

    • Copyright Infringement (DMCA)

    DMCA Compliance

    ShareList complies with the Digital Millennium Copyright Act (DMCA):

  • We respond to valid DMCA takedown notices for allegedly infringing content
  • Copyright holders may report infringing content to: admin@sharelist.live
  • Infringing content will be removed or disabled upon receipt of valid notice
  • Repeat infringers will have their accounts permanently terminated
  • We maintain a policy of terminating accounts of users who repeatedly infringe copyrights

    • Filing a DMCA Notice

    To file a DMCA takedown notice, provide:

  • Identification of the copyrighted work claimed to be infringed
  • Identification of the infringing material and its location in the Service
  • Your contact information (name, address, email, phone)
  • A statement of good faith belief that use is not authorized
  • A statement that the information is accurate and you are authorized to act
  • Your physical or electronic signature

    • Send notices to: admin@sharelist.live with subject "DMCA Takedown Notice"

    Counter-Notification

    If your content was removed due to a DMCA notice and you believe it was removed in error:

  • You may submit a DMCA counter-notification
  • Follow the procedures outlined in the Digital Millennium Copyright Act
  • Include your contact information and a statement under penalty of perjury
  • Content may be restored if the copyright holder does not file a lawsuit within 10 business days

    • List Sharing and Groups

    Shared Lists

  • When you share a list, all invited members can view and edit the list contents and uploaded images
  • You can control who has access to your shared lists
  • Removing someone from a shared list revokes their access to future updates
  • Previously shared content (including images) may remain visible to members who accessed it before removal
  • Shared media : Images uploaded to shared lists become accessible to all list members

    • Group Management

  • Group owners can add or remove members and manage permissions
  • Group admins can moderate content and manage some group settings
  • All group members are responsible for maintaining respectful collaboration
  • We reserve the right to remove users from groups for violating these Terms
  • Group owners are responsible for ensuring members comply with content guidelines

    • Third-Party Services and Dependencies

    The Service relies on third-party providers for various functionalities:

    Service Providers

  • Media Storage : Firebase Cloud Storage (Google) for image uploads and attachments
  • Database Hosting : PostgreSQL for application data storage
  • Email Delivery : SendGrid for transactional emails and notifications
  • Push Notifications : Expo Push Notification Service for mobile alerts
  • Translation Services : OpenAI for multi-language support

    • Authentication Providers

  • Firebase Authentication : User authentication, account management, and session handling
  • Google Sign-In : OAuth provider for Google account authentication
  • Apple Sign-In : OAuth provider for Apple ID authentication

    • Payment Processors

  • Stripe : Payment processing for web subscriptions, template purchases, and creator payouts
  • Stripe Connect : Creator payout infrastructure for template sellers
  • RevenueCat : Mobile subscription and in-app purchase management
  • Apple App Store : iOS payment processing and subscription management
  • Google Play Store : Android payment processing and subscription management

    • Third-Party Limitations

    We are not responsible for :

  • Third-party service outages, interruptions, or downtime
  • Changes to third-party terms, pricing, or service availability
  • Data practices of third-party service providers (each has their own privacy policy)
  • Service functionality if third-party access is revoked or discontinued
  • Loss of data due to third-party service failures (though we maintain backups)

    • Your Acknowledgment

    By using ShareList, you acknowledge:

  • The Service depends on external providers for critical functionality
  • Third-party service disruptions may affect your ability to use ShareList
  • You should review the terms and privacy policies of our third-party providers
  • We will make reasonable efforts to notify you of significant third-party changes

    • Privacy and Data Protection

    Your privacy is important to us. Please review our Privacy Policy , which explains how we collect, use, and protect your information, including:

  • How we store uploaded images and media files
  • Use of third-party services (Firebase, OpenAI, SendGrid, Expo)
  • Push notification data collection and usage
  • Cookie and session management
  • Payment and subscription data handling
  • Payment processor data sharing (Stripe, Apple, Google)
  • Creator payout information processing
  • Your privacy rights under GDPR and CCPA

    • By using ShareList, you consent to the collection and use of information in accordance with our Privacy Policy.

    Intellectual Property

    Our Rights

  • ShareList, its features, and related technology are protected by intellectual property laws
  • Our trademarks, logos, service marks, and branding are our property
  • The ShareList name, design, and app interface are protected
  • You may not use our intellectual property without our written permission

    • User Content

  • You retain rights to your original content, including uploaded images
  • You are responsible for ensuring you have rights to any content you upload
  • You may not upload content that infringes on others' intellectual property rights
  • ShareList does not claim ownership of user-generated content

    • Service Availability and Modifications

    Service Availability

  • We strive to provide reliable service but cannot guarantee 100% uptime
  • We may temporarily suspend the Service for maintenance, updates, or security patches
  • We are not liable for any downtime or service interruptions
  • Third-party service outages may affect ShareList availability

    • Service Modifications

  • We reserve the right to modify, suspend, or discontinue the Service at any time
  • We will provide reasonable notice for significant changes when possible
  • Continued use after modifications constitutes acceptance of the changes
  • We may add, remove, or modify features without prior notice

    • Termination and Account Deletion

    Termination By You

  • You may terminate your account at any time through the Settings page
  • Upon account deletion request, your access to the Service will cease immediately
  • Data deletion timeline :
  • Immediate : Account access disabled
  • Within 7 days : Active data removed from production servers
  • Within 30 days : All personal data and uploaded images permanently deleted
  • Within 90 days : Backup copies completely erased
  • Some provisions of these Terms will survive termination (IP rights, disclaimers, limitations of liability)

    • Termination By Us

    We may terminate or suspend your account immediately if you:

  • Violate these Terms of Service or our content policies
  • Engage in fraudulent, illegal, or abusive activities
  • Upload prohibited, infringing, or harmful content
  • Abuse the Service or other users
  • Fail to pay subscription fees or have repeated payment failures
  • Abuse the free trial system (e.g., creating multiple accounts for trials)
  • Engage in fraudulent template sales or misrepresent template content
  • Create multiple accounts or circumvent bans
  • Pose a security risk to the Service or other users

    • Effects of Termination

    Upon termination or deletion:

  • Active Subscriptions : Will be canceled immediately; no refund for remaining subscription period
  • Creator Earnings : Pending earnings will be paid out within 30 days if above minimum threshold
  • Templates You Created : Will be removed from the marketplace; existing purchasers retain access
  • Templates You Purchased : Access to purchased templates may be retained at our discretion
  • Your uploaded images : Permanently removed from all servers (30-90 day process)
  • Shared lists : Your contributions become anonymized but may remain visible to other group members
  • Personal data : Deleted according to our Privacy Policy retention schedule
  • No refunds : Termination does not entitle you to refunds or compensation for subscriptions
  • Backup deletion : All backup copies removed within 90 days

    • Disclaimers and Limitation of Liability

    Disclaimers

  • The Service is provided "as is" without warranties of any kind, express or implied
  • We do not warrant that the Service will be uninterrupted, error-free, or secure
  • We do not guarantee the accuracy, reliability, or completeness of user-generated content
  • We are not responsible for loss or corruption of uploaded images or data
  • Third-party services may fail or become unavailable without notice

    • Limitation of Liability

    To the maximum extent permitted by law:

  • Our liability is limited to the amount you paid for the Service in the past 12 months
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not responsible for loss of data, images, profits, or business opportunities
  • We are not responsible for template purchase disputes between buyers and sellers
  • We are not liable for delays or failures in payment processing by third-party payment providers
  • Creator earnings are subject to payment processor availability and policies
  • Our total aggregate liability shall not exceed $100 AUD or the amount paid in the preceding 12 months, whichever is greater
  • Some jurisdictions do not allow limitations on implied warranties or liability, so these limitations may not apply to you

    • Indemnification

    You agree to indemnify, defend, and hold harmless ShareList, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your infringement of any third-party rights (including intellectual property and privacy rights)
  • Content you submit, upload, or share through the Service
  • Templates you create and sell through the marketplace
  • Your failure to pay applicable taxes on subscription fees or creator earnings
  • Disputes with template buyers regarding your sold content
  • Your violation of any applicable laws or regulations
  • Any damage caused by uploaded images containing viruses or malicious code

    • Governing Law and Dispute Resolution

    Governing Law

    These Terms are governed by the laws of Victoria, Australia without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts located in Victoria, Australia .

    Dispute Resolution

  • We encourage resolving disputes through direct communication first
  • Contact us at: admin@sharelist.live to attempt informal resolution
  • Any legal disputes will be resolved through binding arbitration in accordance with the rules of Resolution Institute
  • You waive the right to participate in class action lawsuits or class-wide arbitration
  • Small claims court jurisdiction is preserved for qualifying claims

    • Changes to Terms

    We may update these Terms from time to time. We will notify users of material changes by:

  • Posting the updated Terms on our website and in the app
  • Sending email notifications to registered users (if email provided)
  • Displaying in-app notifications for significant changes
  • Updating the "Last Updated" date at the top of this document

    • Your Continued Use : Continued use of the Service after changes become effective constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service and may delete your account.

    Severability

    If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
